Privacy Policy

These Terms apply to TonePilot and the services made available through it by its operator (“TonePilot”, “I”, “me”, or “my”).

TonePilot is an unofficial macOS client for Spark amplifiers.

macOS App

I do not collect personal information through the TonePilot macOS app.

No analytics, advertising trackers, or marketing data collection are present in the TonePilot macOS app.

If TonePilot allows you to log in to a third-party platform for tones or related services, your credentials and account information are processed by that third party, not collected by me. TonePilot may transmit the information you enter only as needed to complete login and provide app functionality.

Information stored locally on your device, such as app preferences, cached data, or session data, is not collected by me unless you choose to send it to me.

Website

The TonePilot website and landing pages may use analytics to measure traffic, conversion rates, and other aggregate performance metrics, and to support product, marketing, and business decisions.

Where possible, website analytics will be configured in a privacy-conscious manner and limited to information reasonably necessary to understand site usage and improve the business.

General

• Third-party platforms accessed through TonePilot may collect and process information under their own privacy policies and terms.
• If you contact me for support, I will receive whatever information you choose to include in your message.

Terms of Service

Acceptance of Terms

By downloading, installing, accessing, or using TonePilot, you agree to be bound by these Terms of Service and by applicable laws and regulations. If you do not agree, you must not use TonePilot.

Unofficial App Notice

TonePilot is an unofficial client for Spark amplifiers. It is not affiliated with, endorsed by, or sponsored by Positive Grid or any other third party unless explicitly stated.

All third-party names, trademarks, product names, and service names are the property of their respective owners.

Third-Party Services and Compatibility

TonePilot includes features that interact with third-party devices, platforms, services, and integrations that I do not control. Those third parties, including Positive Grid, may modify, restrict, suspend, or discontinue compatibility, login methods, APIs, online services, or related functionality at any time and without notice.

Accordingly, I do not guarantee the continued availability of any third-party integration, login flow, online feature, tone-platform access, cloud feature, or compatibility dependent on third-party systems.

If any third-party integration or service becomes unavailable, degraded, limited, or incompatible, that alone will not entitle you to a refund, credit, or other compensation, except where required by applicable law.

TonePilot is provided and sold, if applicable, as a whole product. Access to any specific third-party service or API is not guaranteed and may change or stop working at any time.

Refunds

If TonePilot is offered for a fee, refunds will not be issued solely because a third-party service, login flow, API, or integration is changed, restricted, or discontinued, except where required by applicable law.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

Disclaimer of Warranty

TonePilot is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, or uninterrupted operation.

I make no representation or warranty that TonePilot will:

• operate without interruption, errors, or defects;
• remain compatible with all versions of macOS, Spark hardware, or third-party services;
• be secure or free from bugs, harmful code, or failures; or
• meet your expectations or requirements.

Nothing in these Terms excludes any warranty or legal right that cannot be excluded under applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, I will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of revenue, loss of data, loss of use, business interruption, or other similar damages arising out of or related to your use of, or inability to use, TonePilot.

This includes, without limitation, damages arising from:

• software bugs, crashes, or defects;
• failed or unavailable third-party logins or APIs;
• changes made by Apple, Positive Grid, or other third parties;
• device, firmware, or operating system incompatibility; or
• loss or corruption of presets, tones, settings, or other data.

If I am found liable despite the above limitations, my total liability to you will be limited to the amount you paid for TonePilot, if any, except where a greater amount is required by applicable law.

Acceptable Use

You agree not to use TonePilot:

• in any way that violates applicable law or regulation;
• to interfere with, abuse, or disrupt any third-party service, device, API, website, or platform;
• to attempt unauthorized access to any account, system, server, or data;
• to scrape, overload, reverse engineer, or misuse third-party services through TonePilot where prohibited by law or by applicable third-party terms;
• to transmit malicious code or use TonePilot in a harmful, fraudulent, or abusive manner.

Intellectual Property

Unless otherwise stated, TonePilot and its original code, design, branding, and related materials are owned by me.

Any third-party services, trademarks, software, content, or brand assets referenced or accessed through TonePilot remain the property of their respective owners.

If any part of TonePilot is distributed under an open-source license, that license applies to the relevant source code as stated in the repository or accompanying materials.

Feedback

If you send feedback, suggestions, ideas, or bug reports about TonePilot, you agree that I may use them without restriction or compensation, unless applicable law requires otherwise.

Changes to These Terms

I may update this Privacy Policy and these Terms of Service from time to time. Changes take effect when posted with a revised Last updated date.

Your continued use of TonePilot after any update takes effect means you accept the revised terms. If you do not agree to the revised terms, you must stop using TonePilot.
