TonePilot Privacy Policy and Terms of Service

Privacy Policy
These Terms apply to TonePilot and the services made available through it by its operator (“TonePilot”, “I”, “me”, or “my”).
TonePilot is an unofficial client for Spark amplifiers, available on macOS and the web.
Account and Identity
You can create a TonePilot account through any of the following:
- Email-verified trial. You provide an email address and confirm a verification code sent to that address. The verified email is stored alongside your account so your credits and saved tones travel with you across devices.
- License key (macOS). When you activate a paid license, TonePilot contacts the server to verify the license. The server records the devices the license has been used on so the same license works across the devices you authorize.
Account information is used for license and trial enforcement, credit balance accounting, and customer support. It is not sold or shared with advertisers.
If you opt in to marketing emails when requesting a trial, your email address is added to a marketing list used to send TonePilot announcements. You can opt out at any time using the unsubscribe link in those emails or by contacting support.
AI Tone Generation
TonePilot’s tone-generation feature sends the prompt you type to Anthropic for processing. Anthropic returns a tone preset and short description, which TonePilot then displays. Aside from the prompt itself, no personal account information (such as your email or license key) is sent to Anthropic.
The following is stored on TonePilot servers so I can investigate problems, improve quality, and answer support requests:
- your prompt and the resulting tone preset,
- whether the generation was successful or rejected,
- any rating you give a generated tone,
- the prior conversation when you refine an existing tone.
This information is associated with your account and retained until you delete your account.
Payments
Payments are processed by Stripe. Your payment details (name, email, card information) are collected and processed by Stripe under Stripe’s own privacy policy. I receive only limited information from Stripe such as email, transaction status, and the last four digits of the card, for fulfillment, refunds, and support.
Refunds are handled per the Refund Policy.
Account Deletion
You can delete your TonePilot account at any time. Deletion permanently removes your account, your license, your credits, your saved tones, and your AI conversation history.
On every platform, you can delete your account from Settings → Account → Delete Account.
Some records — such as payment receipts retained by Stripe, security logs retained by Cloudflare, and analytics records retained by PostHog — are outside my control and remain subject to those providers’ retention policies.
Website
The TonePilot website is served through infrastructure providers such as Cloudflare, which may process information such as your IP address, request data, and basic technical information for security, performance, and reliability purposes.
Analytics
TonePilot uses PostHog to understand how the product is used and how trials become purchases.
The events captured include page views, prompts you submit, the outcome of tone generations, ratings, sign-ups, and trial starts.
Third-Party Services
TonePilot uses the following third-party services. Each operates under its own privacy policy:
- Anthropic — AI tone generation
- Stripe — payment processing
- Cloudflare — hosting and infrastructure
- PostHog — product analytics
- Resend — transactional email and, with your opt-in, marketing email
General
- Third-party platforms accessed through TonePilot may collect and process information under their own privacy policies and terms.
- If you contact me for support, I will receive whatever information you choose to include in your message.
Terms of Service
Acceptance of Terms
By downloading, installing, accessing, or using TonePilot, you agree to be bound by these Terms of Service and by applicable laws and regulations. If you do not agree, you must not use TonePilot.
License
Subject to these Terms, I grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use TonePilot for personal use.
Age Requirement
You must be at least 13 years old, or the applicable minimum age in your jurisdiction, to use TonePilot.
Unofficial App Notice
TonePilot is an independent, unofficial application for Spark amplifiers. It is not affiliated with, endorsed by, or sponsored by Positive Grid or any other third party unless explicitly stated.
All third-party names, trademarks, product names, and service names are the property of their respective owners.
TonePilot is independently developed based on publicly observable behavior and is not derived from or based on proprietary source code of any third party.
TonePilot does not represent itself as an official client and does not impersonate any third-party application. Use of TonePilot is subject to third-party terms and availability.
Core Functionality
TonePilot includes local features such as tone creation, editing, storage, and on-device controls that do not depend on third-party services.
Online and Third-Party Features
TonePilot includes features that interact with third-party devices, platforms, and services that I do not control. These features are provided on a best-effort basis and may be unavailable, modified, restricted, or discontinued at any time without notice.
The primary value of TonePilot is its local functionality, which operates independently of third-party services. Access to any third-party service is incidental and not part of the core licensed product. Loss or degradation of online or third-party features does not constitute a defect of the product.
Third parties, including Positive Grid, may change or discontinue APIs, login methods, compatibility, or related functionality at any time. I do not guarantee the continued availability or compatibility of any third-party service, integration, or feature.
TonePilot only interacts with third-party services when initiated by the user through their own accounts and actions. TonePilot does not automate, scrape, or interfere with third-party services beyond user-initiated actions.
You acknowledge that you are not relying on the continued availability of any third-party service, API, or integration when purchasing or using TonePilot. Refund eligibility in such situations is governed by the Refund Policy and applicable law.
You are responsible for your use of third-party services through TonePilot. I am not responsible for any claims, restrictions, or actions taken by third parties resulting from your use of such services.
Updates and Support
Updates to TonePilot are provided free of charge for the lifetime of the product. Updates are delivered at my discretion and I do not guarantee a specific schedule, frequency, or scope of updates.
Support is provided on a best-effort basis and is not guaranteed.
Refunds
TonePilot offers a 30-day money-back guarantee as described in our Refund Policy. That policy governs eligibility and conditions for refunds.
Except as provided in that policy or required by applicable law, all sales are final.
Refund eligibility for loss, degradation, or unavailability of online or third-party features, including changes to services, APIs, or integrations, is governed by the Refund Policy.
Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
Disclaimer of Warranty
TonePilot is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, or uninterrupted operation.
I make no representation or warranty that TonePilot will:
- operate without interruption, errors, or defects;
- remain compatible with all versions of macOS, Spark hardware, or third-party services;
- be secure or free from bugs, harmful code, or failures; or
- meet your expectations or requirements.
Nothing in these Terms excludes any warranty or legal right that cannot be excluded under applicable law.
You use TonePilot at your own risk. I am not responsible for any damage to devices, hardware, firmware, or equipment resulting from use of the app.
Limitation of Liability
To the maximum extent permitted by applicable law, I will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of revenue, loss of data, loss of use, business interruption, or other similar damages arising out of or related to your use of, or inability to use, TonePilot.
This includes, without limitation, damages arising from:
- software bugs, crashes, or defects;
- failed or unavailable third-party logins or APIs;
- changes made by Positive Grid or other third parties;
- device, firmware, or operating system incompatibility; or
- damage to devices, hardware, firmware, or equipment resulting from use of TonePilot; or
- loss or corruption of tones, sounds, settings, or other data.
If I am found liable despite the above limitations, my total liability to you will be limited to the amount you paid for TonePilot, if any, except where a greater amount is required by applicable law.
Acceptable Use
You agree not to use TonePilot:
- in any way that violates applicable law or regulation, or the terms of any third-party service;
- to interfere with, abuse, or disrupt any third-party service, device, API, website, or platform;
- to attempt access to any account, system, server, or data without proper authorization;
- to abuse, overload, scrape in a harmful manner, or otherwise misuse third-party services, devices, APIs, websites, or platforms through TonePilot;
- to transmit malicious code or use TonePilot in a harmful, fraudulent, or abusive manner.
Termination
If you violate these Terms, I may revoke your license key or deactivate your account. Revocation disables the app on your device.
You can also terminate your relationship with TonePilot at any time by deleting your account, as described in the Account Deletion section above.
Intellectual Property
Unless otherwise stated, TonePilot and its original code, design, branding, and related materials are owned by me.
Any third-party services, trademarks, software, content, or brand assets referenced or accessed through TonePilot remain the property of their respective owners.
If any part of TonePilot is distributed under an open-source license, that license applies to the relevant source code as stated in the repository or accompanying materials.
Feedback
If you send feedback, suggestions, ideas, or bug reports about TonePilot, you agree that I may use them without restriction or compensation, unless applicable law requires otherwise.
Governing Law and Jurisdiction
These Terms are governed by the laws of Quebec, Canada, without regard to conflict of law principles.
Any disputes shall be resolved in the courts located in Quebec, Canada.
Changes to These Terms
I may update this Privacy Policy and these Terms of Service from time to time. Changes take effect when posted with a revised Last updated date.
Your continued use of TonePilot after any update takes effect means you accept the revised terms. If you do not agree to the revised terms, you must stop using TonePilot.
